Terms of Service
These Terms of Service (“Terms”) are a binding agreement between you and Custome (“Custome,” “we,” “us,” or “our”) governing your access to and use of our websites, applications, and related services (the “Service”). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.
If you use the Service on behalf of a company, you represent that you have authority to bind that company, and “you” includes that company.
1. The Service
Custome lets you connect a Stripe account, sync active or trialing subscribers, resolve company logos, request or record logo permission, and embed or fetch approved logos that stay current when subscriptions change. Features may change as we improve the product. We do not guarantee uninterrupted or error-free operation.
2. Accounts
You must provide accurate account information and keep your credentials confidential. You are responsible for activity under your account. Notify us promptly of unauthorized use. We may suspend or terminate accounts that violate these Terms or pose a security risk.
3. Plans, trial, and billing
Custome is offered as a paid subscription. Unless we state otherwise in writing: one plan at $19 per month or $190 per year, with a fourteen-day trial after which paid billing begins unless you cancel. Prices are in USD and may change with notice for future periods. Taxes may apply. Fees are generally non-refundable except where required by law or expressly stated by us.
Payment is processed by our payment provider (for example Stripe). Their terms also apply to payment processing. Failure to pay may result in suspension or termination of access.
4. Stripe connection
You may connect a Stripe secret or restricted API key so Custome can read customers and subscriptions. You represent that you have the right to provide that key and to authorize Custome to access the related Stripe data. You should use the least-privilege key that still allows Custome to function.
You remain responsible for your Stripe account, your customers, and compliance with Stripe’s terms. Custome does not create charges on your customers through your connected key and is not a party to your contracts with those customers.
5. Your data, logos, and permissions
You retain ownership of your content and customer data. You grant us a worldwide, non-exclusive license to host, process, transmit, and display that data solely to provide and improve the Service.
You are solely responsible for having all rights, licenses, and permissions needed to display customer names, domains, and logos, including trademark and publicity rights. You agree not to use Custome to create deceptive or unlawful social proof. Permission workflows in Custome help you request approval; they do not replace your legal obligations.
Public embeds and APIs may expose approved logos and related display information to anyone with the public key or page URL. You are responsible for what you publish.
6. Acceptable use
You agree not to:
- Violate law or third-party rights
- Probe, abuse, or disrupt the Service or other users
- Bypass rate limits, access controls, or security measures
- Resell or white-label the Service except as we expressly allow
- Upload malware or attempt to reverse engineer the Service except where law permits
- Misrepresent logos, customers, or subscription status
7. Third-party services
The Service depends on third parties such as Stripe, Logo.dev, email delivery, hosting, and (if you choose) Google or GitHub sign-in. Their availability and terms are outside our control. Your use of those services may be subject to their own policies.
8. Intellectual property
Custome, including its software, branding, and documentation, is owned by us and our licensors. Except for the limited rights to use the Service under these Terms, no rights are granted. Feedback you provide may be used by us without obligation to you.
9. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. LOGO RESOLUTION AND PERMISSION OUTCOMES DEPEND ON THIRD PARTIES AND YOUR INPUTS; WE DO NOT WARRANT THAT EVERY CUSTOMER WILL RESOLVE TO A CORRECT LOGO OR GRANT PERMISSION.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CUSTOME AND ITS AFFILIATES, OFFICERS, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IN ANY TWELVE-MONTH PERIOD WILL NOT EXCEED THE AMOUNTS YOU PAID TO CUSTOME FOR THE SERVICE IN THAT PERIOD (OR USD $50 IF YOU HAVE NOT PAID).
Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the fullest extent permitted.
11. Indemnity
You will defend and indemnify Custome and its affiliates against claims, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your customer or logo content, your Stripe credentials, your violation of these Terms, or your violation of third-party rights or law.
12. Termination
You may stop using the Service and cancel your subscription at any time through available account controls or by contacting us. We may suspend or terminate access immediately for breach, non-payment, legal risk, or misuse. Upon termination, your right to use the Service ends; sections that by nature should survive (including ownership, disclaimers, limitations, and indemnity) will survive.
13. Changes to the Service or Terms
We may modify the Service and these Terms. For material changes to the Terms, we will provide notice (for example by email or in-product notice) and update the “Last updated” date. Continued use after the effective date constitutes acceptance, except where law requires otherwise.
14. Governing law
These Terms are governed by the laws of India, without regard to conflict-of-law rules. Courts in India will have exclusive jurisdiction over disputes, except that we may seek injunctive relief in any jurisdiction to protect our intellectual property or security.
15. General
These Terms are the entire agreement between you and us regarding the Service and supersede prior agreements on that subject. If a provision is unenforceable, the remainder stays in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
